This Contest is organized by Brightstar Distribution Sdn Bhd (Brightstar). By entering and par­ticipating in this Contest, Contestants are deemed to have read, understood and agreed to be bound by these Terms and Conditions.

1. Contest Period

   1. The Contest will commence and run from 29 December 2011 until 7 February 2012 (the “Contest Period”).
   2. The Contest will be closed at 12 midnight on 7 February 2012 or such other time that Brightstar shall decide from time to time. Entries received after the stipulated time will be in­eligible for the prize draw. Brightstar may at its sole and absolute discretion extend the Contest Period at any time without any prior notice (“the Extended Period”). Unless otherwise varied to the contrary, any participation in the Contest during the Extended Period (if any) shall be governed by these terms and conditions which shall remain in full force and effect and shall be read and construed to be enforceable.
   3. Weekly Contest Draw dates are as follows:
      Week 1 : 29 December 2011 to 03 January 2012
      Week 2 : 04 January 2012 to 10 January 2012
      Week 3 : 11 January 2012 to 17 January 2012
      Week 4 : 18 January 2012 to 24 January 2012
      Week 5 : 25 January 2012 to 31 January 2012
      Week 6 : 01 February 2012 to 07 February 2012
   4. Five (5) winners will be selected every week within the contest period of six (6) weeks.

2. Eligibility

   1. To be eligible to enter this contest, Contestants must be 18 years old and above and cur­rently residing in Malaysia;
   2. The following persons are NOT eligible to participate in this Contest:
      1. Permanent and/or contract employees of Brightstar and their immediate family members;
      2. Permanent and/or contract employees of HTC (including its subsidiaries and related com­panies) and their immediate family members.
      3. Representatives and /or agents (including advertising and promotion agents) of Brightstar and HTC and its subsidiaries and related companies, and their immediate family members.

   The phrase “immediate family members” refers to children, parents, spouses, brothers and sisters of the above group of individuals. Should any person listed above do so, such person will be automatically disqualified from the contest.

3. Contest Entry

   1. To participate in the Contest, the Contestant must first purchase to selected HTC smartphones distributed by Brightstar offered at participating outlets.
   2. Contestants must purchase either/any of the following HTC models to be entitled to the Entry Forms: HTC Evo 3D, HTC Sensation XE, HTC Rhyme, HTC Desire S, HTC Desire Z, HTC Wildfire S, HTC ChaCha and/or HTC Explorer.
   3. The Contestants are required to fill in the required information and submit the completed Entry Forms to participating outlets.
   4. Each Contestant can only submit one (1) Entry Form for one purchase of HTC smartphones. Contestant can submit more than one (1) Entry Form, but will only stand a chance to win one (1) prize. Contestants will bear their own charges and/or related cost in submitting their entries for the Contest.
   5. Brightstar reserves the right to reject any Entry Form at its sole and absolute discretion without having to assign reasons whatsoever.
   6. Brightstar reserves right to disqualify incomplete, illegible or false entries.

4. Contestants’ Responsibilities

   Contestants must ensure that all personal details given are true, correct and accurate. Contestants must also ensure that the telephone number provided is in existence and are contactable. Brightstar reserves the rights to verify the information provided by the Contestants in any form it deems fit. The personal information is collected during their initial participation.

5. Selection of Winners

   1. The winner must have fulfill all the criteria below when the winner is selected:
      1. Must be a purchaser of selected HTC smartphones within the period of 29 December 2011 to 7 February 2012.
      2. Complete Entry Forms with details, answer and slogan
      3. Proof of purchase (photocopy of receipt on purchase of HTC smartphone)
      4. IMEI sticker
   2. Each Contestant shall be entitled to win ONE (1) PRIZE only.

6. Judging

   1. Brightstar reserves the right on the selection of judges.
   2. Decision will be based on the following:
      1. Completed Entry Form with correct answer
      2. Most creative, interesting and origin slogan; and
      3. Proof of purchase (photocopy of receipt)
      4. IMEI sticker
   3. The judges’ decision is final. No appeal via correspondence or otherwise will be entertained.

7. Notification of Contest Winners

   1. The Winners will be announced in Brightstar Malaysia and HTC Malaysia Facebook page
   2. Winners will be notified via telephone, post or e-mail should they be selected as the winner as well as the instruction on the collection of prize within fourteen (14) days after announcement.
   3. Brightstar shall not be responsible or be liable if any of the winners cannot be contacted. Brightstar further reserves the full right to disqualify any winner if any attempt to contact them has failed for any reason whatsoever.
   4. Brightstar reserves the right to use any other method or medium that deems fit at its sole and absolute discretion for the purpose of announcing the Contest winners.
   5. Contest winners will be required to give their contact details, I.C No, Mailing address and any other details deemed necessary and relevant to facilitate the collection of prizes.
   6. Brightstar reserves the right to request written proof or residency and age of any Contest winner before the prize is collected.
   7. Proof of submission (in any manner whatsoever) any details to Brightstar does not represent proof that Brightstar has received such details.
   8. In the event that a Contest winner chooses not to accept or failed to collect the prize within fourteen (14) days from the announcement date of the winner, the winner shall forfeit any and all claims to that prize, which will be dealt with according to the absolute discretion of Brightstar. Forfeiture of the prize shall be at the absolute discretion of Brightstar and any claims or appeal shall not be entertained.
   9. Brightstar reserves the right to forfeit prizes for any Contest winner who does not provide the required details upon receiving the request/notification from Brightstar
   10. Brightstar reserves the right to appoint a third party to conduct the verification of Contest winners and to fulfill the collection of prizes and Contestants agree that Brightstar may provide all necessary information of Contest winners to such third party to facilitate such service.

8. Contest Prizes

   1. The prizes for the Contest shall be 30 units of HTC Flyer to be given out within period of 6 weeks. 5 units of HTC Flyer will be given out weekly to 5 winners.
   2. All prizes are not transferable, non-refundable and non-exchangeable/redeemable for cash. Winners are fully responsible for all taxes that may be payable or taxable (if any).
   3. All prizes are subjected to availability. Brightstar reserves the rights to substitute any prize with another of similar value without prior notice and without any compensation whatso­ever to the winners.
   4. All prizes must be claimed by the winners in person. Winners must produce original identity cards for verification. Acceptance and use of prizes by winners shall be at their own and entire risk at all times.
   5. All costs and expenses for the purpose of collection of the prizes shall be solely borne by the winners.

9. Prize Collection

   Contest winner(s) are required to attend at his/her own cost and expense to collect the prize. In the event the Contest winner is not able to collect the prize, the Contest winner must authorize a representative to collect the prize on his/her behalf.

10. Publicity

    1. Brightstar reserves the right, at its sole and absolute discretion, to use the names, answers, slogans and entries of the Contest winner(s) and/or representatives without first obtaining any consent nor making any payment whatsoever to the Contest winner(s) and/or representatives for publicity, advertising, trade or promotion purposes in any media.
    2. The Winners shall not make any public announcement on the Contest (including but not limited to the Prize) without the prior written consent of Brightstar.

11. Variation to the Terms & Conditions

    1. Brightstar reserves the rights to change, amend, delete or add to these Contest Terms and Conditions through either written or verbal communications without prior notice at any time.
    2. By participating in this Contest, Contestants agree to be bound by the contest Rules and Regulations, the Terms and Conditions herein, notices, amendments and all decisions made by Brightstar.
    3. In the event of any dispute, conflict, uncertainty or ambiguity relating to the Terms and Conditions hereto, or any matter involving this Contest, Brightstar will resolve the mat­ter in its absolute and unfettered discretion and the entire decision in the matter shall be conclusive and final.

12. Liability

    Brightstar shall not be responsible or liable for:

    1. To the fullest extent permitted by law, Brightstar makes no representations or warranties with respect to any prizes provided under this Contest; in particular, Brightstar gives no warranty with respect to the merchantability, quality of the prizes or their suitability for any purposes.
    2. Any misinterpretation or misrepresentation of facts in respect of the prizes offered as published in any media, marketing or advertising materials.
    3. Any problem, loss or damage of whatsoever nature suffered by any party including the Contestants or their authorized representatives resulting from their participation in the Contest or due to any delay and/or failure in receiving and sending the entry form as a result of any network, communication or system error, unavailability of forms, interruption and/or failure experi­ence by the participating and/or resulting from participation in the Contest. In the event of such error, interruption and/or failure, Brightstar shall not be responsible or liable for any failure by any Contestant to participate in the Contest at any time.
    4. Any error (including error in notification of Contest winners), omission, interruption, deletion, defect, delay in operation or transmission, internet line failure, theft, destruction of, or unauthorized access to entries, server hang whether or not arising during opera­tion or transmission as a result of server functions, virus, bugs or other causes outside its control.
    5. The Contestants will assume full liability in the case of any mishap, injury, damage, claim or accidents resulting from their participation in the Contest and/or redemption of the prizes.
    6. Brightstar shall not be liable for any failure to comply with its obligations where the failure is caused by something within its reasonable control. Such circumstances shall include, but not be limited to, weather conditions, fire, flood, hurricane, strike, industrial dispute, war, hostilities, political unrest, riots, civil commotion, inevitable accidents, supervening legislation or any circumstances amounting to force majeure.
    7. Brightstar shall not be liable to the Contestants for (a) any loss or damage suffered by the Contestants arising from their participation or non-participation in the Contest due to any act or omission by Brightstar and; (b) for any misuse of any prize or for any claims or liability arising from the use of the prizes.

13. Disqualification

    1. Brightstar reserves the right at its sole discretion to disqualify any individual for the following:
       1. that it determines to be tampering with the entry process or the operation of the Contest,
       2. to be acting in breach or potential breach of these Contest Terms and Conditions.
    2. The decision to disqualify is final and no correspondence shall be entertained.
    3. Brightstar reserves the right, with or without cause, to exclude participants and withhold prizes for violating any of the terms and conditions herein.

14. Suspension, Cancellation Or Termination of Contest

    1. Brightstar reserves the right to cancel, suspend, delay or terminate the Contest at its absolute discretion without giving prior written notice to the Contestant or in the event of unforeseen circumstances beyond its reasonable control.
    2. In the event of suspension, cancellation, delay or termination of the Contest for any reason by Brightstar, the Contestant or the Winner shall not be entitled to make any claim or claim for compensation from Brightstar for any loss or damages suffered or incurred by the Contestants as a direct or indirect result of the suspension, cancellation, delay or termina­tion of the Contest.

15. Governing Law and Jurisdiction

    This Contest shall be governed by the laws of Malaysia and the courts in Malaysia shall have exclusive jurisdiction.
