Terms and Conditions

  1. This seasonal program organized by Brightstar Distribution Sdn Bhd (Co. No. 687093-H) (“Brightstar“) called the “BlackBerry® New Year Promotion!” (the “program”) shall run from 15th December 2011 to 15th January 2012 (both dates inclusive) (the “Program Period“). Under the Program, AirAsia e-vouchers (“vouchers”) valued RM300 will be given out for the first 1,500 registered BlackBerry® Bold™ 9900 white edition and e-vouchers valued RM150 will be given out for the first 1,500 registered BlackBerry® Curve™ 9360 white edition.
Eligibility
  1. The Program is open to any individual who is a resident of Malaysia (“Applicant”) whose registration for the program, as described on Brightstar’s website -
    www.brightstar.com.my/newyearblackberry (“Website”), is successfully approved during the Program Period EXCEPT FOR:
    1. Permanent and/or contract employees of Brightstar Distribution Sdn Bhd (including their respective subsidiaries and related companies) and their respective immediate family members;
    2. Representatives and/or agents (including advertising and promotion agents) of Brightstar (including their respective subsidiaries and related companies), their respective permanent and/or contract employees and their respective immediate family members;
    3. Persons who have left the employment of Brightstar with effect from 1st Nov, 2010;
  2. For the purpose of these Terms and Conditions, a registration is “successfully approved” only if it is submitted during the Program Period and is approved by Brightstar no later than 15th January 2012. A conditional approval of an application which may be received by an Applicant from Brightstar is not deemed to be a “successfully approved” registration.
  3. Brightstar reserves the right at its absolute discretion to approve or reject any registration and/or the supporting documents as requested by Brightstar. For the avoidance of doubt, Brightstar reserves the right at its absolute discretion to determine if the supporting documents are sufficiently clear for purposes of the approval.
  4. Each registration which is successfully approved shall hereinafter be called a “BlackBerry Owner”.
The Program
  1. During the Program Period, a BlackBerry owner will be entitled to such number of program entries
    (“Program Entries”) as are stated below in the following scenarios:

    1. One (1) Program Entry upon successful approval of his/her registration for the Program.
    2. Each Program Entry for each purchases of BlackBerry for models stated below within the program period base on successful registration.
      1. BlackBerry Bold 9900 white edition
      2. BlackBerry Curve 9360 white edition
  1. The first 1,500 BlackBerry owners of BlackBerry Bold 9900 white edition and the first 1,500 owners of BlackBerry Curve 9360 white edition who submitted their registration successfully before the program end date will be entitled for this vouchers as stated in term 1.
  2. Registration will be done thru the BlackBerry smartphone device in which the user will be required to download a registration application thru a provided QR CODE / URL and registration will be downloaded via Over-The-Air. Data charges charged by carriers will be incurred and will be borne by user for application download and submission of registration details.
  3. The following terms and conditions apply to the Prizes:
    1. the Prizes are subject to availability from the suppliers. In the event that the suppliers are unable to supply any Prize to Brightstar, Brightstar reserves the right at its absolute discretion to substitute the Prize with another product of similar retail value at any time without prior notice;
    2. the Prizes are provided on an “As Is” basis and AirAsia will email successful applicants within 15 days of successful registration;
    3. the Prizes will be in electronic form and to be redeemed directly from www.airasia.com.my;
    4. the Prizes are not exchangeable for cash, credit or kind, in part or in full; and
Waiver/Exclusion from Liability
  1. To the fullest extent permitted by law, each Account-holder who participates in the Program is deemed to have waived any right he/she may have against Brightstar and its officers, servants, employees, representatives and/or agents (including without limitation, any third party service providers that Brightstar may engage for the purposes of this Program), in respect of any loss or damages (including without limitation, loss of income, profits or goodwill, indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties) howsoever arising whether in contract, tort, negligence or otherwise, in connection with the Program and/or the Prizes, even if Brightstar has been advised of the possibility of such damages in advance, and all such damages are expressly excluded.
  2. Brightstar shall not be liable for any default or loss due to any act of God, war, riot, strike, lockout, industrial action, fire, flood, drought, storm, epidemic, pandemic, technical or system failures or any event beyond the reasonable control of Brightstar.
  3. To the fullest extent permitted by law, any and all representations and/or warranties with respect to the Prizes are hereby excluded. In particular, Brightstar gives no warranty with respect to the quality or merchantability of the Prizes or its suitability or fitness for any purpose.
  4. The AirAsia e-vouchers are purchased from AirAsia Bhd (Company No. 284669-W) (“AirAsia”). Brightstar shall not be responsible for any defect or any other loss or damage that may be suffered in connection with any of the Prizes. Any dispute in relation to the validity, warranty or quality of any vouchers or any terms and conditions in respect thereof shall be settled directly between the relevant customers and AirAsia, as the case may be. Brightstar will bear no responsibility for resolving any dispute and the customer must liaise directly with AirAsia, as the case may be, and not Brightstar in this regard.
  5. For the avoidance of doubt, Brightstar’s only responsibility in regard to the Program shall be to grant the e-vouchers to the first 3,000 registered customers. Brightstar shall not be responsible to bear any costs or expenses whatsoever of the e-vouchers for the purpose of or in connection with the expenditure by any of them.
General
  1. Brightstar’s decision on all matters relating to the Program, including the interpretation of these Terms and Conditions, the determination of the number of Program Entries to be allotted and the determination of first 3,000 selected registrants, will be final and binding and no further correspondence or attempts to dispute such decisions will be entertained.
  2. Brightstar reserves the right at its absolute discretion to vary, delete or add to any of these Terms and Conditions from time to time with notice. These Terms and Conditions may be modified, added, deleted or varied by Brightstar by way of posting on the Website, or in any other manner deemed suitable by Brightstar. The BlackBerry owners who participate in the Program are deemed to have accessed the Website and to have knowledge of and to have agreed to any changes or variations to these Terms and Conditions.
  3. Brightstar reserves the right to cancel, terminate or suspend the Program with notice by way of posting on the Website, or in any other manner deemed suitable by Brightstar. The BlackBerry Owners are deemed to have accessed the Website and to have knowledge of and to have agreed to such cancellation, termination or suspension of the Program. For the avoidance of doubt, cancellation, termination or suspension by Brightstar of the Program shall not entitle Account-holders to any compensation whatsoever against Brightstar for any and all loss or damage that may be suffered or
    incurred by any Account-holder as a direct or indirect result of the act of cancellation, termination or suspension.
  4. BlackBerry owners who participate in the Program are deemed to have expressly agreed to be bound by these Terms and Conditions (as modified and varied from time to time) and, to the fullest extent permitted by law, to have consented to and authorized Brightstar to disclose their particulars to the third party service providers engaged by Brightstar for the purposes of the Program (if any). Brightstar warrants that the disclosure of such particulars to any third party service providers shall be limited to the BlackBerry Owners’ names, addresses and telephone numbers and shall be used only in relation to and for the purposes of the Program.
  5. Winners are deemed to have given their consent for their photographs and names to be published in the media, in Brightstar’s publications and/or on the Website for the purpose of advertisements and publicity by Brightstar.
  6. In the event that it is discovered that an BlackBerry owner:
    1. is not eligible by virtue of Clause 2 above; and/or
    2. has committed or is suspected of committing any fraudulent or wrongful act in relation to his/her use of any Brightstar services or facilities (including Brightstar Online); and/or Brightstar reserves the right to disqualify such a person from participating in the Program and/or receiving any of the Prizes. If such person had won the Grand Prize, it must be returned to Brightstar and will then be awarded to the next best Shortlisted candidate who didn’t obtain any of the above mentioned vouchers.
